On January 2, 2020, Flats on Memorial LLC submitted an application for rezoning 18.939 acres of vacant land between N. Memorial Drive and N. Columbus Street/Nelson Road.  This property is located to the east of the Big Sandy Superstore and behind Burger King, KFC, and other nearby commercial establishments along N. Memorial Drive.

​The property is currently zoned Residential Single-Family (RS-3) and Commercial General (CG), but the petitioner has proposed to change the zoning to Residential Multi-Family with a Planned Unit Development (RM-2/PUD) overlay (see explanation of "Planned Unit Development" below).

The first step for this zoning change request is for it to go before​Lancaster City Planning Commission.  Planning Commission will consider this rezoning request during a Public Hearing on February 13, 2020 at 9:30 am on the second floor conference room in City Hall at 104 E. Main Street.  Planning Commission will make a recommendation regarding the application, and that recommendation, along with the application, will be forwarded to City Council for consideration.

TIMELINE

​The general timeline for the rezoning process is as follows (the timeline does not include all considerations and you should refer to Lancaster Codified Ordinance Chapter 1147 for more details):

​Rezoning application, including the Development Plan, submitted on January 2, 2020

​Required public notification (Letters, Newspaper Advertisement, and Signage) provided by January 24, 2020

​Planning Commission hearing on February 13, 2020

​Planning Commission will vote on the application and send their recommendation to City Council (TENTATIVELY February 13, 2020)

Legislation to rezone the property will be introduced at City Council (TENTATIVELY February 27, 2020) ​

Legislation to rezone the property will go three readings, including another Public Hearing, and be voted upon by City Council (TENTATIVELY March 24, 2020)

What is a "Planned Unit Development (PUD)"?

A Planned Unit Development (PUD) is a supplemental zoning designation that allows the owner more flexibility and creativity when developing a property.  Generally speaking, PUDs are subject to fewer zoning requirements, but in return for these concessions, the submission of a Development Plan is required as part of the PUD approval process.  A Development Plan describes exactly what is being constructed on the property and exactly how the property will be laid out.  Furthermore, once a Development Plan is approved by the City, changes to the Development Plan cannot be made by the owner without additional Public Hearing(s) and approval(s) from Planning Commission and/or City Council, depending on the severity of the change.  For these reasons, we often describe PUDs as "what you see is what you get" since it is clear from the start of the process exactly what will be constructed on the property before the rezoning is approved.
